Saya membeli emas 10gram, goldbar 999. Harganya RM1700. Setiap bulan saya mendapat diskaun sebanyak RM14 untuk setiap 1gram. Paling awal saya boleh mengambil emas ialah selepas tiga bulan dan paling lewat ialah selepas 36 bulan.<\/p>\n<p><a href=\"http:\/\/www.ashadee.net\/go\/49887\/emasshahir?b=1368\"><img decoding=\"async\" class=\"aligncenter\" alt=\"\" src=\"http:\/\/www.ashadee.com\/banners\/banner_0017104_rahsia_emas_11.jpg?b=1368\" \/><\/a><\/p>\n<p><strong>PENJELASAN:<\/strong><\/p>\n<p>Pemberian diskaun dalam penjualan emas adalah dibenarkan sekiranya pembelian emas dibayar dengan matawang selain daripada emas, seperti pembelian emas menggunakan perak, atau pembelian emas menggunakan mata wang kertas (spt. RM, USD). Manakala dalam pembelian\/pertukaran emas dengan emas, diskaun pada harga adalah tidak dibenarkan kerana antara syarat khas jual beli emas dengan emas ialah tam\u0101thul (persamaan) pada kadarnya.<\/p>\n<p>Dalam skim yang disebut dalam soalan di atas, tidak ada isu syariah berkaitan dengan pemberian diskaun kerana emas dibeli dengan menggunakan duit kertas iaitu Ringgit Malaysia. Tetapi wujud isu kelewatan dalam penyerahan emas, kerana emas tidak diserahkan serta-merta selepas pembelian sebaliknya diserahkan seawal-awalnya selepas tiga bulan.<\/p>\n<p>Ini tidak menepati salah satu syarat asasi dalam jual beli iaitu taq\u0101budh yang menghendaki penyerahan emas dan pembayaran harga dilakukan dalam satu majlis iaitu ketika akad jual beli dijalankan. Dalam Parameter Pelaburan Emas, syarat tersebut disebut sebagaimana berikut: Parameter No. 11: Taqabudh (penyerahan) hendaklah berlaku terhadap kedua-dua item jual beli iaitu harga dan juga barang belian (emas), dan ia hendaklah terlaksana sebelum kedua-dua pihak berpisah daripada majlis akad.<\/p>\n<p>Justeru, akad jual beli emas sebagaimana skim yang disebutkan dalam soalan adalah tidak sah kerana tidak menepati syarat jual beli emas, dan tidak menepati Parameter Pelaburan Emas yang telah diperakukan oleh Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia Kali Ke-96 yang bersidang pada 13-15 Oktober 2011.
