Dia beli emas 100g dengan harga RM 18k. Harga pasaran RM15k. Dia jual semula di hujung bulan kepada syarikat yg sama dgn harga RM21k, untung RM3k. Perjanjian dgn syarikat emas tersebut selama 3 tahun. Apa hukumnya?<\/p>\n<p><a href=\"http:\/\/www.ashadee.net\/go\/49887\/emasshahir?b=1368\"><img decoding=\"async\" class=\"aligncenter\" alt=\"\" src=\"http:\/\/www.ashadee.com\/banners\/banner_0017104_rahsia_emas_11.jpg?b=1368\" \/><\/a><\/p>\n<p><strong>Jawapan.<\/strong><\/p>\n<p>Ia adalah pakej jual beli emas yang bermasalah. Sekiranya emas yang dibeli sudah diterima, dan munkin dilakukan secara taqabud dan tunai di dalam majlis aqad, maka ia selamat dari masalah riba pada jual beli emas secara bertangguh. Sekiranya emas tidak diterima, maka ia adalah riba pada jual beli emas. Adapun menjual semula kepada syarikat pada hujung bulan dengan harga yang lebih tinggi, ia adalah bay\u2019 al-inah. Walaupun tidak disyaratkan jual balik, qarinah kepada perancangan dan persetujuan kepada jual semula sangat jelas. Tidak ada pembeli biasa yang bodoh membeli emas yang jauh lebih mahal dari harga pasaran, kecuali kerana inginkan ganjaran buyback dengan harga yang lebih tinggi walaupun tersangat jauh dari harga pasaran.<\/p>\n<p>Perjanjian selama 3 tahun? Berapa kali nak jual emas yang sama? Kalau sudah dijual, macam mana nak dijual lagi? Tak masuk akal. Mana boleh jual barang yang tiada. Tidak sah jual beli.<\/p>\n<p>Kemunkinan besar, emas tidak diterima oleh pembeli\/pelabur, ia hanyalah tempahan secara ETA, dan apabila tiba tempoh sebulan, dibeli balik dengan harga yang lebih mahal.
